The automatic receipt of this communication will not necessarily imply the definitive acceptance of the order when there is a manifest error in the price, lack of availability, inability to verify payment, indications of fraud, or any other justified circumstance that prevents its processing.<\/li>
                • THE LUMINE TRADING, S.L.U. reserves the right to reject or cancel an order when payment has not been authorized, there are outstanding amounts corresponding to previous orders, incorrect or incomplete data has been provided, fraudulent use of the platform is detected, or any other legitimate cause occurs. In the event that any charge has been made and the order is subsequently canceled, the corresponding amounts will be refunded using the same payment method used, whenever possible.<\/li>

THE LUMINE TRADING, S.L.U. will adopt the appropriate technical and organizational measures to protect personal data, preserve its confidentiality, and prevent its alteration, loss, processing, or unauthorized access, taking into account the nature of the data and the risks associated with its processing.<\/li><\/ul>
                  • The customer may receive commercial information, news, promotions, and offers from The Lumine when they have given their consent or when there is another legal basis that allows the sending of such communications. They may withdraw their consent or request to unsubscribe at any time through the link provided in each communication or through the contact channels indicated on the website.<\/li>
                  • These General Sale Conditions will be governed and interpreted in accordance with Spanish legislation, without prejudice to the mandatory protection provisions that may apply to the consumer based on their place of residence.<\/li>
                  • In the event of disagreement related to the interpretation or execution of these conditions or with an order placed at The Lumine, the parties will attempt to reach an amicable solution beforehand.                     Legal warranty of the products<\/strong><\/p>

                    THE LUMINE TRADING, S.L.U. offers this information as a guarantee of the quality of the products and services marketed through The Lumine.<\/p>

                    Products purchased by consumers and users have a legal warranty of conformity of three years from the date of delivery, in accordance with Royal Legislative Decree 1\/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, and with the rest of the applicable regulations.<\/p>

                    This warranty is recognized without prejudice to any other rights that legally correspond to the consumer.<\/p>

                    Cases not covered by the warranty<\/strong><\/p>

                    The warranty will not cover damages or deficiencies that do not originate from a manufacturing defect or a lack of conformity existing at the time of delivery.<\/p>

                    Excluded are, among others, damages caused by:<\/p>

                        • Impacts, falls, accidents, negligence, or improper handling.<\/li>
                        • Incorrect assembly, installation, or electrical connection.<\/li>
                        • Installations made without following the instructions provided with the product.<\/li>
                        • Modifications, repairs, or interventions carried out by unauthorized persons.<\/li>
                        • Use of bulbs with a socket, voltage, or power different from those indicated in the lamp specifications.<\/li>
                        • Surges, irregularities in the electrical network, or connections to installations that do not comply with applicable regulations.<\/li>
                        • Use of the product for a purpose other than that for which it was designed.<\/li>
                        • Exposure to water, humidity, condensation, or weather when the lamp has not been expressly designed and certified for that use.<\/li>
                        • Exposure to extreme heat sources, fire, or objects at high temperatures.<\/li>
                        • Damage caused by domestic animals.<\/li>
                        • Damage caused by tools, sharp objects, or abrasive elements.<\/li>
                        • Use of inappropriate cleaning products, solvents, bleaches, acetones, or aggressive chemical substances.<\/li>
                        • Failure to comply with the recommendations for conservation, cleaning, and maintenance.<\/li>
                        • Wear or deterioration resulting from normal use of the product, provided that there is no manufacturing defect or lack of conformity.<\/li>
                        • Breakage of glass, marble, alabaster, ceramic, or other delicate materials occurring after delivery due to impacts, falls, or improper handling.<\/li><\/ul><\/li><\/ul><\/li><\/ul>

                          The exhaustion resulting from normal use of a replaceable bulb will not be considered a defect of the lamp, without prejudice to the warranty that corresponds to the light source itself.<\/p>

                          In lamps with integrated LED lighting, any possible lack of conformity of the light source will be analyzed as part of the product itself, in accordance with applicable regulations.<\/p>

                          Solutions in case of lack of conformity<\/strong><\/p>

                          When an incident covered by the legal warranty is detected, THE LUMINE TRADING, S.L.U. will apply the corresponding solution in accordance with current legislation.<\/p>

                          The consumer may request the repair or replacement of the product, unless one of these options is impossible or involves disproportionate costs compared to the other alternative.<\/p>

                          The repair or replacement will be free for the consumer and will include, when appropriate, the necessary transportation, materials, and labor costs.<\/p>

                          When the repair or replacement is not possible, is not carried out within a reasonable time, or any of the legally provided cases occur, the consumer may request a proportional reduction of the price or the resolution of the contract.<\/p>

                          Damage caused during transport<\/strong><\/p>

                          At the time of delivery, the customer must check the external condition of the packaging before signing the carrier’s delivery note.<\/p>

                          When the packaging shows impacts, perforations, deformations, humidity, breakages, or any other anomaly, it must be noted on the delivery note or CMR with a clear annotation, such as DAMAGED PACKAGING<\/strong> or PENDING REVIEW<\/strong>.<\/p>

                          It is recommended to take photographs or videos of the packaging before opening it, as well as of the product, the interior protections, the transport labels, and any detected damage.<\/p>

                          Shortages, losses, breakages, or defects occurring during transport must be reported to The Lumine as soon as possible and preferably within the first 24 hours from delivery. Whenever possible, the communication should not be made later than 72 hours from receipt, as this will allow for proper management of the claim with the transport company.<\/p>

                          The incident must be communicated through the user account, the after-sales service form, or via email <\/strong>, including:<\/p>

                              • Order number.<\/li>
                              • Reference of the affected product.<\/li>
                              • Detailed description of the incident.<\/li>
                              • Photographs or videos of the packaging and the product.<\/li>
                              • Copy of the delivery note, when available.<\/li><\/ul><\/li><\/ul><\/li><\/ul>

                                Failure to communicate within the recommended time frames may hinder the claim against the carrier, but will not by itself result in the loss of the legal rights corresponding to the consumer due to a lack of conformity.<\/p>

                                The customer must keep the original packaging, protections, and all accessories until the incident has been reviewed and the product is completely assembled, installed, and checked.<\/p>

                                Quality claims and hidden defects<\/strong><\/p>

                                It is recommended to check the product immediately after receipt and report any visible defects as soon as possible.<\/p>

                                However, the recommended internal deadlines for reporting visible damage will not limit the consumer’s right to claim the lack of conformity that manifests within the legal warranty period.<\/p>

                                Claims must be properly documented with photographs, videos, and a detailed description that allows for the identification of the product and assessment of the incident.<\/p>

                                Right of withdrawal<\/strong><\/p>

                                Consumers who purchase standard products through The Lumine’s website may exercise their right of withdrawal within the legal period of fourteen calendar days from the receipt of the order, in accordance with the conditions established in the corresponding section of the website.<\/p>

                                The right of withdrawal is independent of the legal warranty.                                 The cost of transport may vary depending on the delivery address, destination, weight, volume, characteristics of the purchased products, and the selected delivery service.<\/p>

                                The applicable shipping costs will be displayed during the purchasing process, before the customer confirms and pays for the order. When applicable, these costs will be added to the price of the products and will appear itemized in the final summary of the purchase.<\/p>

                                THE LUMINE TRADING, S.L.U. may modify the prices of its products and shipping rates at any time, especially when there are variations in the costs applied by specialized transport companies for lighting fixtures and delicate products.<\/p>

                                However, the order will be invoiced according to the prices and rates in force at the time of its confirmation, unless there is a manifest error in the price, and always subject to the availability of the products.<\/p>

                                Retention of title<\/strong><\/p>

                                THE LUMINE TRADING, S.L.U. will retain ownership of the products sold until full payment of the price has been received, including, when applicable, taxes, shipping costs, and other amounts associated with the order.<\/p>

                                In case of total or partial non-payment, THE LUMINE TRADING, S.L.U. may suspend the preparation or delivery of the order and exercise the actions that legally correspond.<\/p>

                                The retention of title will not affect the legal rules regarding the transfer of risk. In sales made to consumers, the risk of loss or deterioration of the product will be transferred when the customer, or a third party designated by them other than the carrier, materially receives the goods.<\/p>

                                When the customer hires a transport company on their own that has not been proposed by The Lumine, the risk may be transferred at the moment the product is delivered to that carrier, in accordance with applicable regulations.<\/p>

                                Product availability<\/strong><\/p>

                                Orders will be accepted based on the stock available in The Lumine’s warehouses and the availability communicated by its manufacturers and suppliers.<\/p>

                                THE LUMINE TRADING, S.L.U. will make all reasonable efforts to keep the information regarding stock updated and to properly attend to the received orders. However, the inclusion of a product on the website does not constitute an absolute guarantee of availability.<\/p>

                                In exceptional circumstances, it may happen that a product appears as available at the time of placing the order, but is out of stock due to a pending inventory update, a logistical incident, a stock break, or a synchronization error.<\/p>

                                If, after confirming the order, any of the products are not available, The Lumine will inform the customer as soon as possible by email or phone.<\/p>

                                In that case, the customer will be offered, as appropriate:<\/p>

                                    • To wait for the replenishment of the product, when there is an estimated date of availability.<\/li>
                                    • To replace it with another product of similar characteristics and price, upon express acceptance by the customer.<\/li>
                                    • To partially receive the order and obtain a refund for the unavailable product.<\/li>

                                      The Lumine will not replace a product with another without the prior authorization of the customer.<\/p>

                                      When a refund is to be made, it will be carried out without undue delay and, whenever possible, using the same payment method used for the purchase. No additional costs will be applied to the customer as a result of such return.<\/p>

                                      Payment by card<\/strong><\/p>

                                      In payments made by credit or debit card, the order will not be considered confirmed until the transaction has been authorized by the bank or the corresponding payment service provider.<\/p>

                                      If the payment is not authorized, is rejected, or cannot be verified correctly, the order cannot be accepted or processed.<\/p>

                                      Card payments will be processed through a secure payment gateway provided by the bank or the corresponding payment service provider.                                       The availability and delivery times may vary depending on the state of the product, the destination country or area, and logistical conditions. This information will be clearly displayed on the data sheet of each reference.<\/p>

                                      • Fast delivery:<\/strong> Some of our lamps are available in stock in our warehouses. These references can be prepared and shipped in a short period, to which the corresponding transport time must be added according to the delivery address and the conditions of the shipping agency.<\/li>
                                      • Upcoming delivery:<\/strong> Certain models are expected to arrive at our warehouses in limited quantities. These references will be available for preparation and shipping from the estimated date indicated on The Lumine’s website.                                         The lamps will be prepared using appropriate packaging and protections for transport. In the case of luminaires that incorporate glass, marble, alabaster, ceramic, or other delicate materials, specific protections will be used to reduce the risk of damage during handling and shipping.<\/p>

                                        Preparation and delivery times<\/strong><\/p>

                                        The estimated preparation or availability period will be indicated on the data sheet of each product or will be communicated to the customer before confirming the order.<\/p>

                                        This period must be added to the transport time to the address indicated by the customer. The duration of the shipment may vary depending on the country, destination area, and the conditions of the transport agency.<\/p>

                                        The indicated times are estimated and may be affected by exceptional circumstances beyond The Lumine’s control, such as logistical incidents, supplier delays, transport interruptions, strikes, adverse weather conditions, fires, floods, or other force majeure events.<\/p>

                                        When a significant delay occurs, The Lumine will inform the customer as soon as possible and will make all reasonable efforts to expedite delivery.<\/p>

                                        Shipping costs<\/strong><\/p>

                                        Shipping costs will be calculated based on the delivery address, destination, and general characteristics of the order.<\/p>

                                        The corresponding amount will be displayed during the purchasing process, before the customer confirms and pays for the order.<\/p>

                                        Additional services requested by the customer, such as urgent delivery or delivery within a specific time frame, may incur additional costs. The availability of these services will depend on the transport agency and must be expressly requested and agreed upon before the order is shipped.<\/p>

                                        Delivery method<\/strong><\/p>

                                        The lamps marketed by The Lumine will be sent via messenger or conventional parcel services and will be delivered to the address indicated by the customer, in accordance with the conditions of the selected transport agency.<\/p>

                                        Standard delivery does NOT include:<\/p>

                                            • Unpacking the product.<\/li>
                                            • Assembling the lamp.<\/li>
                                            • Installing or connecting the electrical supply.<\/li>
                                            • Final placement of the lamp.<\/li>
                                            • Removing the packaging.<\/li><\/ul><\/li><\/ul><\/li><\/ul>

                                              These services will only be included when expressly stated in the order or have been contracted and confirmed separately.<\/p>

                                              The electrical installation must be carried out following the instructions provided with the product and, when necessary, by a qualified professional.<\/p>

                                              Contact and scheduling of delivery<\/strong><\/p>

                                              When the transport service allows, the agency may contact the customer by phone, email, or message to communicate the expected delivery date or provide information about the shipment tracking.<\/p>

                                              The dates and time slots communicated by the carrier will be approximate, unless a guaranteed delivery time service has been expressly contracted.<\/p>

                                              The customer must provide a valid phone number and email address, as well as remain reachable during the management and delivery of the order.<\/p>

                                              Failed delivery or absence of the customer<\/strong><\/p>

                                              The customer must ensure that the address and contact details provided are complete and correct, as well as being available to receive the order.<\/p>

                                              When the transport agency previously communicates a delivery date, the customer must take reasonable measures necessary for a person to receive the package at the indicated address.<\/p>

                                              If delivery cannot be made due to unjustified absence, incorrect address, inability to contact, or failure to comply with a previously scheduled appointment, the actual and justified additional costs resulting from:<\/p>

                                                  • A new delivery.<\/li>
                                                  • Temporary storage of the merchandise.<\/li>
                                                  • Returning the order to the warehouse.<\/li>
                                                  • Making a new shipment.<\/li><\/ul><\/li><\/ul><\/li><\/ul>

                                                    The customer will be informed of these costs before organizing a new shipment when necessary.<\/p>

                                                    Receiving and reviewing the order<\/strong><\/p>

                                                    At the time of delivery, the customer must check the external condition of the packaging before signing the delivery note or accepting the receipt of the package.<\/p>

                                                    If they observe impacts, perforations, humidity, deformations, breakages, manipulated seals, or any other visible anomaly, they must note it on the delivery note or device of the carrier with a clear indication, such as:<\/p>

                                                    DAMAGED PACKAGING<\/strong>
                                                    HIT PACKAGE<\/strong>
                                                    PENDING REVIEW<\/strong><\/p>

                                                    When it is not possible to include an observation at the time of delivery, it is recommended to reject the package if it shows evident external damage or take photographs before proceeding to open it.<\/p>

                                                    The customer must document any incident with photographs or videos in which the following can be clearly observed:<\/p>

                                                        • The external condition of the package.<\/li>
                                                        • The transport labels.<\/li>
                                                        • The impacted or damaged areas.<\/li>
                                                        • The interior protections.<\/li>
                                                        • The product and the affected parts.<\/li><\/ul><\/li><\/ul><\/li><\/ul>

                                                          Any damage, defect, or lack of components must be communicated to The Lumine as soon as possible, indicating the order number and attaching a detailed description of the incident along with the corresponding photographs or videos.<\/p>

                                                          The customer must keep the packaging, boxes, labels, and original protections until they have verified that the luminaire and all its components are in perfect condition and function correctly.<\/p>

                                                          The disposal of the packaging before completing the verification of the product may hinder the management of a claim with the transport agency.<\/p>

                                                          Accuracy of delivery data<\/strong><\/p>

                                                          The customer will be responsible for checking that the data provided during the purchase is correct and complete, especially:<\/p>

                                                              • First and last name.<\/li>
                                                              • Delivery address.<\/li>
                                                              • Number, floor, door, or other necessary information.<\/li>
                                                              • Postal code and locality.<\/li>
                                                              • Destination country.<\/li>
                                                              • Phone number.<\/li>
                                                              • Email.<\/li><\/ul><\/li><\/ul><\/li><\/ul>

                                                                The customer must communicate any error or modification of this data before the order has been shipped.<\/p>

                                                                The Lumine will not be responsible for delays, additional costs, or failed deliveries caused solely by incorrect, incomplete, or outdated data provided by the customer.<\/p>

                                                                Force majeure<\/strong><\/p>

                                                                THE LUMINE TRADING, S.L.U.<\/strong> will not be responsible for delays caused by unforeseeable, unavoidable events, or events beyond its reasonable control, such as transport strikes, logistical interruptions, conflicts, fires, floods, natural disasters, traffic restrictions, border closures, or extraordinary incidents in the supply chain.<\/p>
